TUMISHAUser Service Agreement
1. THE SERVICE
Tumisha is a cross-border purchasing-agent service. We buy products listed on Chinese
online marketplaces on your behalf and ship them to your address in Kenya or Ghana.
2. YOUR ACCOUNT
You are responsible for keeping your login credentials safe and for the activity on
your account. You must be at least 18 years old to use the service. You may delete
your account at any time from the app.
3. PRICING
Prices shown in KES or GHS are converted from CNY at the exchange rate displayed at
checkout. The service fee (and any applicable minimum service fee) is shown
separately at checkout. The rates and amounts displayed when you confirm an order
are the ones that apply to that order.
4. PAYMENT
Orders are prepaid in full via the payment methods available in the App (as shown at checkout, e.g. M-Pesa, cards and PayPal). Your order enters fulfilment after payment is confirmed.
5. SHIPPING FEES
International shipping is charged per kilogram by actual or volumetric weight
(whichever is higher). Rates for standard and sensitive goods are shown in the
in-app freight calculator and at checkout.
6. IMPORT TAXES AND DUTIES
Import duties, VAT and any other charges imposed by the customs authority of your
delivery country (Kenya or Ghana) are the responsibility of the recipient and are NOT
included in the price you pay to Tumisha.
7. DELIVERY TIME
Estimated delivery times depend on suppliers, international logistics and customs
clearance. They are estimates, not guarantees. We will keep you informed of your
parcel status in the app.
8. CANCELLATION, RETURNS AND REFUNDS
- Before we purchase the item: you may cancel for a full refund.
- After purchase but before international shipment: refunds follow the upstream
marketplace's refund policy; amounts recovered are refunded to you.
- After international shipment: returns are generally not possible; damaged or wrong
items are handled case by case through customer support.
Custom-made, personalised and clearly-marked non-returnable goods cannot be returned.
9. PROHIBITED AND RESTRICTED ITEMS
You may not order goods that are illegal in China or in your delivery country
(Kenya or Ghana), or restricted by air
transport rules (e.g. flammables, batteries outside permitted categories, and items
listed in the app's restricted list). We may cancel such orders and refund you.
10. LIABILITY
We are responsible for purchasing the correct item from the supplier and delivering
it to the carrier. We are not liable for the inherent quality of goods chosen by you,
nor for delays caused by customs, force majeure or events beyond our reasonable
control. Our total liability is limited to the amount you paid for the affected order.
11. INTELLECTUAL PROPERTY
The Tumisha app, name and logo belong to us. Product images and titles belong to
their respective sellers and are displayed for purchasing purposes only.
12. GOVERNING LAW
This agreement is governed by the laws of the Republic of Kenya, without prejudice to mandatory rights you have under the consumer-protection law of your country of residence.
13. CHANGES AND TERMINATION
We may update this agreement and will notify you in the app. You may stop using the
service at any time; we may suspend accounts that violate this agreement or the law.
